Telangana Advocates Protection Act Comes Into Force, Marking Landmark Reform for Lawyer Safety
The Telangana Government has officially brought the Telangana Advocates Protection Act, 2026 into force, making the state one of the first in India to implement a dedicated law aimed at protecting advocates from violence, intimidation and harassment while performing their professional duties. The Act came into effect on June 2, 2026, following a government notification issued under the powers conferred by the legislation.
The law was enacted after the Telangana Legislative Assembly passed the Advocates Protection Bill earlier this year and the Governor subsequently granted assent. The legislation is intended to address the growing number of attacks and threats faced by lawyers and to ensure that they can represent clients without fear or external pressure.
One of the key features of the Act is the provision for police protection to advocates facing credible threats arising out of their professional work. It also introduces safeguards against false criminal cases, malicious prosecution and retaliatory harassment, while establishing a dedicated grievance redressal mechanism to promptly address complaints from members of the legal fraternity.
The legislation criminalises acts such as assault, grievous hurt, criminal force, criminal intimidation and damage to the property of advocates when such acts are connected with the discharge of their professional duties. It also provides for stringent penal action against offenders and empowers authorities to take swift action in investigating and prosecuting such offences.
The enactment follows sustained demands from the Bar Council of Telangana, High Court Bar Associations and advocates across the state, who had repeatedly sought a special legal framework after several incidents of violence against lawyers. The state government has described the Act as a significant step towards strengthening the rule of law by ensuring that advocates, who play a vital role in the administration of justice, can perform their duties independently and without intimidation.
Legal experts have noted that the Telangana law is broader in scope than similar legislation in several other states. Besides protecting advocates from physical attacks, it extends safeguards against intimidation, harassment and professional victimisation, reflecting a more comprehensive approach to ensuring the independence of the legal profession. At the same time, some constitutional experts have called for judicial scrutiny of certain provisions to ensure they strike an appropriate balance between protecting advocates and preventing misuse.
With the Act now in force, Telangana joins a select group of states—including Rajasthan, Karnataka and others pursuing similar reforms—that have enacted dedicated legislation for the protection of advocates. The development is expected to strengthen confidence within the legal community and could influence other states considering comparable laws for the safety and security of lawyers.
