The case that decriminalized homosexuality in India is Navtej Singh Johar v. Union of India. On September 6, 2018, the Supreme Court of India unanimously declared Section 377 of the Indian Penal Code unconstitutional in so far as it criminalized consensual sexual conduct between adults of the same sex. The court held that criminalizing consensual homosexual acts was irrational, arbitrary, and infringed on constitutional rights including equality, privacy, and dignity under Articles 14, 15, 19, and 21 of the Indian Constitution. This landmark decision struck down the colonial-era law that had criminalized “unnatural offenses” and affirmed the fundamental rights of the LGBTQ community in India.
