Supreme Court Weighs Framework for Special Sunday and Holiday Hearings in Urgent Cases
In a move that could transform emergency access to justice in India, the Supreme Court is considering a mechanism to ensure that constitutional courts remain accessible even outside regular working hours, including on Sundays and public holidays, for cases involving life and personal liberty. The proposal follows a Public Interest Litigation (PIL) highlighting that emergencies do not adhere to court schedules and that constitutional remedies should be available whenever fundamental rights are under immediate threat.
The petition urges the Supreme Court to institutionalise a Standard Operating Procedure (SOP) that would allow litigants to approach courts during nights, weekends and holidays in exceptional situations such as illegal detention, custodial violence, imminent demolition, forced deportation, medical emergencies and other matters where any delay could result in irreversible consequences. At present, access to judges outside normal court hours is largely dependent on extraordinary administrative arrangements rather than a uniform system.
During the hearing, the Bench led by Chief Justice of India Justice Surya Kant, along with Justices Joymalya Bagchi and V. Mohana, acknowledged that protection of life and liberty cannot be confined to office hours. The Court observed that if the executive can take action at any hour, citizens should also have an effective mechanism to seek immediate judicial protection whenever their fundamental rights are threatened.
The proposed SOP could pave the way for special Sunday sittings and hearings on public holidays whenever an urgent matter cannot wait until the next working day. Such hearings are not unprecedented. Indian courts have, on several occasions, convened late-night or holiday benches to hear death penalty appeals, habeas corpus petitions, election disputes and other extraordinary matters where immediate judicial intervention was considered essential. However, these have largely been exceptional responses rather than part of a formal institutional framework.
The Supreme Court has sought the views of High Courts across the country on whether a uniform protocol can be devised for handling such emergency petitions. The proposed framework may include designated judges, streamlined filing procedures, emergency registry support and virtual hearing facilities to ensure that urgent constitutional matters receive prompt judicial attention irrespective of the day or time.
Legal experts believe that the move, if implemented, would significantly strengthen the constitutional guarantee of access to justice by reducing dependence on ad hoc arrangements and ensuring greater transparency in emergency listings. At the same time, the Court has cautioned that any such system must include safeguards to prevent misuse through artificially created urgency while preserving judicial resources for genuinely exceptional cases.
The matter is expected to assume considerable constitutional importance in the coming months. After receiving responses from the High Courts, the Supreme Court may frame comprehensive guidelines governing emergency judicial access across India, potentially introducing a structured mechanism for special Sunday, holiday and after-hours sittings in cases where immediate intervention is necessary to protect life, liberty and other fundamental rights.
