Supreme Court Awards ₹1.46 Crore Compensation to Paraplegic Road Accident Victim, Reiterates Need for ‘Just Compensation’
In a significant judgment reinforcing the principles governing motor accident compensation, the Supreme Court has enhanced the compensation payable to a road accident victim who was rendered paraplegic, awarding a total of ₹1.46 crore. The Court held that compensation under the Motor Vehicles Act must reflect the lifelong physical, emotional and financial consequences suffered by victims of catastrophic injuries and should not be confined to a narrow mathematical calculation.
The Bench observed that a person left permanently disabled due to another’s negligence loses far more than earning capacity. The Court stressed that tribunals must account for the victim’s lifelong medical treatment, rehabilitation, attendant care, pain and suffering, loss of amenities, reduced quality of life and future financial insecurity while determining “just compensation.” It noted that such awards must ensure a life of dignity rather than mere survival.
The victim suffered devastating spinal injuries in the road accident, resulting in permanent paraplegia and complete dependence on others for daily activities. The Supreme Court found that the compensation awarded by the lower forums failed to adequately consider the lifelong impact of the disability and the continuous expenditure required for medical assistance, physiotherapy, mobility aids and personal attendants.
While substantially enhancing the compensation, the Court carefully recalculated various heads of damages, including loss of future earning capacity, future medical expenses, attendant charges, pain and suffering, loss of marital prospects and loss of enjoyment of life. The judgment reaffirmed that victims suffering permanent disabilities deserve a realistic assessment based on the actual challenges they will face throughout their lives rather than an overly conservative approach.
The Bench also emphasized that the Motor Vehicles Act is a beneficial social welfare legislation intended to provide effective relief to accident victims. Courts and Motor Accident Claims Tribunals, it observed, must adopt a humane and pragmatic approach while assessing compensation, particularly in cases involving young victims or those left with irreversible disabilities. The objective is to restore, as far as money can, the dignity and security lost because of the accident.
Legal experts believe the ruling will serve as an important precedent for Motor Accident Claims Tribunals across the country. By recognising the true cost of lifelong disability and insisting on comprehensive compensation, the Supreme Court has reinforced the principle that accident victims should receive fair and meaningful financial support that reflects the full extent of their losses rather than token amounts.
