“Process Should Be Fair”: Supreme Court Protects Individuals Declared Foreigners in Assam
In a significant judgment reinforcing procedural fairness in citizenship determination, the Supreme Court has set aside orders declaring 27 individuals in Assam as foreigners, holding that the process of deciding citizenship or foreigner status must be “fair, lawful and reasonable.” The Court ruled that the severe consequences flowing from such a declaration—including detention, deportation, separation from family and even the possibility of statelessness—require strict adherence to the principles of natural justice.
The Bench overturned judgments of the Gauhati High Court that had affirmed the decisions of the Foreigners’ Tribunals against the appellants. It directed that the cases be heard afresh, ensuring that the affected individuals receive a meaningful opportunity to establish their claim to Indian citizenship. The Court underscored that while the State has a legitimate interest in identifying illegal immigrants, such an objective cannot be pursued by compromising procedural fairness.
Emphasising the constitutional dimensions of the issue, the Supreme Court observed that the determination of citizenship is not an ordinary administrative exercise. A declaration that a person is a foreigner can fundamentally alter their life by exposing them to detention, deportation and loss of legal rights. Therefore, Foreigners’ Tribunals and appellate courts must ensure that proceedings comply with the principles of natural justice, including providing adequate opportunity to produce documents, examine witnesses and contest the evidence relied upon by the authorities.
The Court also clarified that tribunals must carefully evaluate all documentary and oral evidence before arriving at a conclusion. Technical lapses or procedural shortcomings should not become the sole basis for depriving an individual of citizenship when the consequences are so grave. The judgment reiterates that fairness in procedure is an indispensable component of the rule of law and constitutional governance.
The ruling comes against the backdrop of long-standing citizenship disputes in Assam, where Foreigners’ Tribunals adjudicate cases under the Foreigners Act and related legal framework. These proceedings have often attracted judicial scrutiny because an adverse declaration may result in detention and eventual deportation. By ordering fresh hearings, the Supreme Court has reaffirmed that tribunals must conduct citizenship inquiries with the highest degree of procedural fairness and judicial care.
Legal experts believe the judgment strengthens constitutional safeguards for individuals facing citizenship proceedings. While recognising the government’s authority to detect and remove illegal immigrants, the Court has made it equally clear that such powers must be exercised through a transparent, lawful and fair adjudicatory process. The decision reinforces that due process is not a procedural formality but a substantive constitutional guarantee, particularly where a person’s nationality, liberty and identity are at stake.
