Know Thy Judge | Supreme Court of India: Justice Ujjal Bhuyan’s Distinguished Career and Notable Judgments
Justice Ujjal Bhuyan has emerged as one of the Supreme Court’s most respected voices on constitutional governance, civil liberties, judicial independence, and transparency. Since his elevation to the Supreme Court on 14 July 2023, he has been part of several significant constitutional and public law decisions while consistently emphasizing the protection of individual rights and adherence to the rule of law.
Born in Guwahati, Justice Bhuyan comes from a distinguished legal family. He studied at Cotton College before earning his law degree and began practising in the Gauhati High Court, where he handled constitutional, civil, service, taxation and public law matters. In 2010, he was designated as a Senior Advocate and was appointed Additional Advocate General of Assam shortly before being elevated as a judge of the Gauhati High Court in 2011. He later served in the Bombay High Court, the Telangana High Court and became the Chief Justice of the Telangana High Court before joining the Supreme Court.
Justice Bhuyan has developed a judicial philosophy centred on constitutional freedoms, fairness in criminal justice and accountability of public institutions. His opinions frequently underline that constitutional rights cannot be curtailed merely on executive convenience and that courts must remain vigilant in safeguarding democratic values.
Among his notable Supreme Court decisions is the judgment granting bail to former Delhi Deputy Chief Minister Manish Sisodia in the Delhi excise policy cases. The Bench stressed that prolonged incarceration without timely trial undermines the constitutional guarantee of personal liberty under Article 21 and reaffirmed that bail jurisprudence must remain rooted in fairness rather than punishment before conviction.
Justice Bhuyan has also been part of important rulings concerning preventive detention, electoral rights, environmental regulation and administrative accountability. Across these cases, he has consistently advocated strict judicial scrutiny whenever State action affects fundamental rights or departs from constitutional safeguards.
Beyond the courtroom, Justice Bhuyan has recently attracted attention for his candid observations on judicial reforms. Speaking at a legal event, he called for greater transparency in the Supreme Court Collegium system, arguing that reasons for judicial appointments and transfers should ordinarily be disclosed in the public interest. He warned that opacity in appointments could undermine confidence in the judiciary and leave room for unsuitable selections.
In another recent lecture, Justice Bhuyan expressed concern over delays in granting bail and the increasing criminalisation of ordinary conduct. Using a striking example that “there is no law prohibiting consumption of chicken over the Ganga,” he emphasized that constitutional courts must guard against arbitrary restrictions on personal liberty and ensure timely judicial intervention.
Legal scholars often describe Justice Bhuyan as a judge who combines constitutional idealism with practical judicial reasoning. His judgments frequently balance institutional restraint with robust protection of civil liberties, reflecting a jurisprudence that places individual dignity, procedural fairness and constitutional accountability at the centre of judicial decision-making.
With his retirement due in May 2027, Justice Ujjal Bhuyan continues to contribute to several constitutionally significant cases before the Supreme Court. His opinions on liberty, transparency and judicial independence are expected to remain influential in shaping Indian constitutional law during the remainder of his tenure.
