Gujarat High Court Upholds Death Sentence for 38 Convicts in 2008 Ahmedabad Serial Blasts Case

Nearly 18 years after one of India’s deadliest terror attacks, the Gujarat High Court has upheld the death penalty for 38 convicts and confirmed life imprisonment for 11 others, reaffirming the 2022 special court verdict in the 2008 Ahmedabad serial blasts case.

The Gujarat High Court on Tuesday dismissed all appeals challenging the convictions and sentences awarded by a special court in the 2008 Ahmedabad serial blasts case, confirming the death penalty for 38 convicts and life imprisonment for 11 others. The Division Bench of Justices A.Y. Kogje and Samir Dave upheld the trial court’s judgment after an extensive review of the evidence and legal arguments.

The case relates to the coordinated serial bomb blasts that struck Ahmedabad on 26 July 2008, when 21 improvised explosive devices exploded across the city within about 70 minutes, killing 56 people and injuring more than 200 others. Several explosions targeted crowded public places, including buses, while two blasts occurred at hospitals where victims of the earlier explosions were being treated, intensifying the scale of the tragedy.

Investigators alleged that members of the banned terror outfit Indian Mujahideen orchestrated the attacks as part of a larger conspiracy. The investigation, conducted by Gujarat Police with support from central agencies, led to the arrest of dozens of accused from multiple states. The prosecution relied on forensic evidence, witness testimonies, electronic records and other material gathered during one of India’s largest terrorism investigations.

The trial itself was among the longest and most complex criminal proceedings in recent Indian judicial history. A special court heard the consolidated cases over more than a decade before delivering its verdict in 2022, convicting 49 of the 77 accused, while acquitting the remaining accused for lack of sufficient evidence. The court awarded death sentences to 38 convicts and life imprisonment to 11 others, calling the case one of the “rarest of rare” instances warranting capital punishment.

With Tuesday’s ruling, the High Court affirmed both the convictions and the sentences imposed by the special court. The Bench rejected the appeals filed by the convicts while also deciding the statutory confirmation proceedings required for death penalty cases. A detailed copy of the judgment is expected to provide the court’s reasoning on evidence, criminal conspiracy and sentencing principles.

The High Court also directed the Gujarat government to provide enhanced compensation to victims and their families. According to reports, the court ordered ₹10 lakh for the families of those who lost their lives, ₹5 lakh for victims who suffered grievous injuries and ₹1 lakh for those who sustained simple injuries, recognizing the devastating human impact of the attacks.

Legal experts note that the judgment reinforces India’s strict judicial approach toward terrorism-related offences while emphasizing that convictions in such cases must be supported by comprehensive evidence. The case has frequently been cited as one of the country’s most significant terrorism prosecutions because of its scale, the number of accused and the extensive judicial scrutiny involved.

The legal process, however, is not yet over. Since the death penalty has been affirmed by the High Court, the convicted individuals retain the right to challenge the judgment before the Supreme Court. Any execution of the death sentences can take place only after all judicial remedies, including appeals, review and curative petitions, are exhausted, followed by the constitutional mercy petition process if invoked.
