Delhi High Court Closes Vinesh Phogat’s Petition Against WFI, Directs Decision on Show-Cause Notice Within Two Weeks
Court Disposes of Plea as Asian Games Selection Issue Becomes Infructuous, Allows Fresh Challenge to Wrestling Federation’s Selection Policy
The Delhi High Court has disposed of Olympian and Congress MLA Vinesh Phogat’s petition against the Wrestling Federation of India (WFI), directing the federation to take a final decision on the show-cause notice issued to her within two weeks after granting her a personal hearing. The Court observed that the relief relating to the 2026 Asian Games selection trials had become infructuous following the conclusion of the selection process.
Justice Swarana Kanta Sharma passed the order while hearing Phogat’s petition challenging both the WFI’s show-cause notice dated May 9, 2026, and the federation’s selection policy that had rendered her ineligible to compete in the Asian Games selection trials. With the trials already over, the Court held that no effective relief could now be granted on that aspect and accordingly closed the proceedings.
However, the High Court protected Phogat’s right to pursue her broader legal challenge. It clarified that if she wished to question the legality of the WFI’s selection policy or the governing circulars, she would be at liberty to file a fresh petition raising those issues independently. The Court observed that such questions required separate adjudication and could not be examined once the original petition had become infructuous.
The Court simultaneously directed the Wrestling Federation of India to conclude the disciplinary proceedings arising from the show-cause notice within two weeks. It instructed the federation to provide Phogat with an adequate opportunity of being heard before passing a reasoned order in accordance with law and the applicable regulations.
The controversy originated after the WFI issued a 15-page show-cause notice accusing Phogat of indiscipline, violating anti-doping-related procedural requirements applicable to athletes returning from retirement, and allegedly bringing disrepute to Indian wrestling following the Paris Olympics controversy. The federation also declared her ineligible to participate in domestic competitions until June 26, citing the mandatory notice period prescribed under its regulations.
During earlier hearings, the Delhi High Court had expressed serious reservations about the WFI’s action. The Court questioned the federation’s decision to exclude one of India’s most accomplished wrestlers from domestic competition and had observed that certain language used in the show-cause notice appeared prima facie harsh and vindictive. It had also directed the Central Government to constitute an expert panel to examine Phogat’s eligibility before permitting her to participate in the Asian Games selection trials.
The dispute later reached the Supreme Court after the WFI challenged the Delhi High Court’s interim order permitting Phogat to compete in the selection trials. The apex court eventually treated the federation’s appeal as infructuous in light of subsequent developments, leaving the substantive legal issues open for future consideration.
The latest order ensures that the disciplinary proceedings before the Wrestling Federation of India cannot remain pending indefinitely. By prescribing a two-week deadline, the High Court has emphasized the importance of procedural fairness and timely decision-making by sports governing bodies while preserving Phogat’s right to mount a separate constitutional challenge to the federation’s rules and selection framework.
The case continues to attract considerable attention within the sporting community, as its eventual outcome may influence the manner in which disciplinary proceedings, athlete eligibility, maternity return policies and selection regulations are interpreted by sports federations in India. The WFI’s decision on the show-cause notice, expected within the next two weeks, could determine Phogat’s future participation in domestic and international wrestling competitions.
