Brazil Court Bars Former President Jair Bolsonaro From Receiving Visitors for 30 Days
In a fresh escalation of legal restrictions imposed on former Brazilian President Jair Bolsonaro, Brazil’s Supreme Federal Court has ordered that he cannot receive any visitors for 30 days, except for his lawyers and medical personnel. The order was issued by Supreme Court Justice Alexandre de Moraes, who found that Bolsonaro had violated the conditions of his house arrest by communicating political messages through third parties.
According to the court, the latest restrictions stem from a letter written by Bolsonaro that was later published on social media by his son, Senator Flávio Bolsonaro, who is contesting Brazil’s upcoming presidential election. In the letter, Bolsonaro called for unity among his political allies and urged support for his son’s presidential campaign. Justice Moraes held that the publication amounted to an indirect breach of the former president’s prohibition on engaging in political communication or using social media.
Under Friday’s order, Bolsonaro will be prohibited from receiving visitors for a period of 30 days, with exceptions made only for legal counsel and healthcare professionals. The court also barred him from receiving visitors for political or electoral purposes until the conclusion of the election period and reiterated that he must refrain from issuing political statements either directly or through intermediaries.
The latest ruling follows an earlier order by Justice Moraes that prohibited Senator Flávio Bolsonaro from visiting his father for 90 days. The judge concluded that the senator had facilitated the violation of the house arrest conditions by posting the former president’s letter online. Flávio Bolsonaro criticized the decision as disproportionate and alleged that it amounted to judicial interference in the electoral process.
Jair Bolsonaro is serving humanitarian house arrest after being sentenced to more than 27 years’ imprisonment for his role in an alleged conspiracy to overturn the results of Brazil’s 2022 presidential election. Owing to health concerns, the court permitted him to serve his sentence under house arrest but imposed strict conditions, including a ban on using mobile phones, social media, or communicating political messages through third parties.
The Bolsonaro camp has continued to argue that the restrictions are politically motivated and excessively restrictive, while supporters of the court maintain that the measures are necessary to enforce judicial orders and prevent continued violations of the terms of house arrest. The latest decision further intensifies the confrontation between Brazil’s judiciary and the country’s most prominent right-wing political figure ahead of the October presidential elections.
The ruling underscores the Brazilian Supreme Court’s determination to strictly enforce the conditions attached to Bolsonaro’s house arrest. By expanding the restrictions to include a temporary ban on visitors and prohibiting any political interaction, the court has signalled that any attempt to influence public discourse or electoral politics while under judicial supervision will attract immediate and stricter sanctions.
