Apex Court Says It Cannot Regulate a Chief Minister’s Public Statements or Official Visit; DMK Withdraws Plea After Strong Judicial Observations

The Supreme Court on Tuesday refused to entertain a plea filed by the Dravida Munnetra Kazhagam (DMK) seeking to restrain Tamil Nadu Chief Minister C. Joseph Vijay and certain ministers from making public comments on the Karur stampede case, which is currently under investigation by the Central Bureau of Investigation (CBI). The Court made it clear that Vijay is not an accused in the case and questioned whether it could regulate the speech or itinerary of an elected Chief Minister.

The application was moved urgently ahead of Chief Minister Vijay’s scheduled visit to Karur on July 10, where he is expected to meet families of the stampede victims, distribute ex gratia compensation, and hand over compassionate appointment orders. The DMK alleged that public statements by Vijay and Tamil Nadu ministers could influence witnesses and affect the ongoing CBI investigation.

During the hearing, Senior Advocate Ranjit Kumar, appearing for the DMK, argued that repeated public comments by ministers were creating a narrative around the tragedy despite the Supreme Court having earlier transferred the investigation to the CBI. He sought judicial directions preventing political leaders from commenting on the merits of the case while the probe remains pending.

The Bench of Justices K.V. Viswanathan and Alok Aradhe, however, expressed strong reservations over the request. Justice Viswanathan remarked that the Court could not be expected to regulate the Chief Minister’s movements or dictate what an elected executive head should do in the course of governance. The Bench also questioned whether granting such relief would amount to imposing an injunction on free speech.

During the proceedings, the Bench also corrected a factual error after the applicant’s counsel referred to Chief Minister Vijay as an accused in the case. The Court clarified that Vijay is not an accused in the Karur stampede FIR, a distinction that became central to the Court’s observations while declining to interfere.

The judges further observed that political disagreements should ordinarily be answered in the political arena rather than through judicial restrictions on speech. The Court suggested that if one political party disagrees with another’s public narrative, the appropriate remedy is public debate rather than seeking prior restraint orders from the judiciary.

Following the Court’s observations, the DMK chose to withdraw its application. As a result, no directions were issued restricting Chief Minister Vijay’s visit, interaction with victims’ families, or public statements relating to the case. The CBI investigation into the Karur stampede will continue independently in accordance with the Supreme Court’s earlier orders.

The ruling underscores the Supreme Court’s reluctance to impose prior restraints on political speech or interfere with the functioning of an elected executive unless there is a clear legal basis. At the same time, the Court reaffirmed that the ongoing criminal investigation must proceed without judicial micromanagement of political activity, leaving any evidentiary issues arising from public statements to be addressed through the investigative and trial process.
