Court Finds Investigation Failed to Meet Legal Standards, Says Criminal Proceedings Cannot Continue on Defective Probe

In a significant ruling on anti-corruption investigations, the Karnataka High Court has quashed the disproportionate assets case registered against Sarfaraz Khan, holding that the investigation conducted by the Lokayukta Police suffered from serious legal defects. The Court concluded that the prosecution could not be sustained because the probe itself was fundamentally flawed and failed to satisfy the requirements of criminal law.

The case concerned allegations that Sarfaraz Khan had amassed assets disproportionate to his known sources of income. Acting on these allegations, the Lokayukta Police registered a case under the provisions of the Prevention of Corruption Act and initiated an investigation into his financial affairs. However, the High Court found that the investigation did not comply with mandatory legal safeguards required for such prosecutions.

While examining the records, the High Court observed that investigators had failed to establish a proper legal foundation before initiating the criminal proceedings. The Bench noted that merely alleging possession of disproportionate assets is insufficient unless the investigation is carried out strictly in accordance with statutory requirements and supported by legally admissible material.

The Court emphasized that criminal prosecution under anti-corruption laws demands a fair, impartial and legally sustainable investigation. Any departure from prescribed procedures can prejudice the rights of the accused and undermine the integrity of the prosecution. Since the defects went to the root of the investigation, the Court held that allowing the proceedings to continue would amount to an abuse of the judicial process.

The judgment reiterates the principle that courts will not permit criminal trials to proceed where the foundational investigation is vitiated by procedural or legal irregularities. It stressed that investigative agencies must strictly adhere to the safeguards embedded in criminal law, particularly in corruption cases carrying serious consequences for public servants.

Legal experts say the ruling serves as an important reminder that anti-corruption investigations, while essential for public accountability, must also comply with constitutional guarantees of fairness and due process. Courts have consistently held that procedural safeguards are not technical formalities but integral components of a fair criminal justice system.

The High Court’s decision does not amount to a declaration on the merits of the allegations themselves. Instead, it rests on the finding that the investigation was legally unsustainable in its present form, making continuation of the criminal proceedings impermissible. Unless a fresh investigation is initiated in accordance with law, the prosecution arising from the defective probe cannot continue.

The ruling is expected to have broader implications for investigations conducted by anti-corruption agencies across Karnataka. It underscores that while combating corruption remains a vital public objective, investigative authorities must ensure strict compliance with statutory procedures, as any substantial procedural lapse may result in courts setting aside criminal proceedings at the threshold.
