Allahabad High Court Directs UP Government to Frame Fire Safety SOP, Fix Accountability After Lucknow Fire Tragedy
Court says loss of lives was preventable, questions regulatory failures and seeks a comprehensive framework to ensure fire safety compliance across Uttar Pradesh.
The Allahabad High Court has directed the Uttar Pradesh Government to formulate a comprehensive Standard Operating Procedure (SOP) on fire safety and establish a clear mechanism to fix accountability for officials responsible for lapses that contribute to fire-related tragedies. The directions came while hearing a public interest litigation arising from the devastating Lucknow fire incident that claimed at least 15 lives.
Expressing deep concern over the incident, the Division Bench observed that the tragedy was entirely preventable had statutory authorities discharged their responsibilities diligently. The Court remarked that authorities often become active only after disasters occur, but their urgency soon fades, allowing similar incidents to recur due to systemic negligence.
The Bench questioned the manner in which commercial establishments and multi-storey buildings were permitted to function despite apparent violations of fire safety norms. It also sought explanations regarding illegal building approvals, deficiencies in inspections, and the effectiveness of the existing regulatory framework governing fire safety in the State.
To prevent recurrence of such incidents, the High Court directed the State Government to prepare a detailed SOP prescribing responsibilities for all concerned departments, including local development authorities, municipal bodies, fire services and other regulatory agencies. The proposed framework is expected to include periodic inspections, compliance verification, emergency preparedness and prompt enforcement against violations.
The Court further emphasized that accountability cannot end with registration of criminal cases after a tragedy. It stressed that public officials responsible for granting approvals, conducting inspections or overlooking safety violations must also be identified and held answerable wherever negligence is established.
During the proceedings, the Bench also expressed concern over regulatory provisions that exempt certain categories of buildings, including those below a specified height, from stringent fire safety requirements. The Court indicated that such exemptions require careful review if they compromise public safety.
The Lucknow fire, which occurred in a three-storey commercial building housing an animation centre and other establishments, exposed serious deficiencies such as inadequate emergency exits and alleged non-compliance with mandatory fire safety measures. Investigations by the State Government are already underway to determine the causes of the blaze and identify those responsible for the lapses.
Legal experts believe the High Court’s intervention could become a watershed moment for fire safety governance in Uttar Pradesh. By directing the Government to institutionalize preventive measures and fix administrative accountability, the Court has shifted the focus from post-disaster response to proactive enforcement, with the potential to influence future policy and regulatory reforms across the State.
