Delhi Court Remands Swatantra Bhardwaj to One-Day Police Custody, CJP Lawyer Questions Procedure
A Delhi court on Saturday remanded Swatantra Bhardwaj to one day of police custody in connection with the alleged assault on the father of a teenage Cockroach Janta Party (CJP) activist during a protest at Jantar Mantar.
Bhardwaj was produced before the court after Delhi Police arrested him following his detention in Bulandshahr, Uttar Pradesh, on Friday. Police had been searching for him after a video from a podcast circulated widely in which he allegedly discussed the assault.
The case relates to an altercation during a CJP protest at Jantar Mantar. The alleged victim, identified in reports as Sanjay Kumar, is the father of student activist Nishu Azad. The protesters had accused Bhardwaj of attacking Kumar during the demonstration.
The controversy intensified after a podcast clip circulated in which Bhardwaj was reported to have claimed that he had “cracked the skull” of the protester’s father and had escaped imprisonment. The remarks triggered renewed demands for his arrest and a fresh public debate over how the original case had been handled.
Delhi Police, however, has disputed some of the claims surrounding the extent of Kumar’s injuries. Police said Kumar sustained a head injury caused by a metal kada worn by one of the alleged attackers, and that medical records described the injuries as simple. Police also said the claim of a skull fracture was not supported by the medical examination.
The police have maintained that the original investigation was conducted according to law. Officials denied allegations of political interference and said Bhardwaj and another accused, Suraj Kumar, had initially been detained and questioned before notices were issued during the investigation.
The latest arrest followed growing pressure from CJP supporters, who on Friday marched to the Parliament Street Police Station demanding immediate action. The group said the police had assured them that Bhardwaj would be arrested within 72 hours.
Bhardwaj was subsequently traced to Bulandshahr. Police sources said he attempted to leave the area before eventually being detained. Reports said he had been staying in the district and was located after investigators tracked his movements.
The court’s decision to grant only one day of police custody has now become another point of contention. Counsel representing the CJP side questioned the manner in which the arrest and remand proceedings were handled and raised concerns about the police’s intentions and the speed of the judicial process.
The lawyer described the situation as “very strange,” particularly in light of the circumstances surrounding the original assault complaint, the viral podcast remarks and the subsequent arrest. The questions focus not only on Bhardwaj’s alleged conduct but also on whether the investigation has followed a consistent procedure from the beginning.
Meanwhile, the police investigation is continuing. Authorities are examining statements, medical records, video material and other evidence connected with the Jantar Mantar incident.
The legal position remains that the allegations against Bhardwaj must ultimately be established through evidence and judicial proceedings. His arrest and one-day police remand do not amount to a finding of guilt.
The case has also acquired a wider public dimension because of the role of social media. The viral podcast clip appears to have brought renewed attention to an incident that had already been investigated months earlier, prompting political and activist groups to demand stronger action.
There are also competing narratives surrounding the incident. CJP supporters have portrayed the alleged assault as a serious act of violence requiring strict prosecution, while Bhardwaj has reportedly claimed that he acted in self-defence and has questioned the interpretation of the viral material.
The Delhi court’s one-day remand means police now have a limited period to question Bhardwaj and advance the investigation before he is brought back before the court.
The proceedings are likely to remain under close scrutiny, particularly over the alleged assault, the medical evidence, the viral statements attributed to Bhardwaj and the concerns raised by the CJP lawyer regarding procedure.
For now, the central legal question is whether the prosecution can establish through admissible evidence what happened during the Jantar Mantar confrontation and what role Bhardwaj played in the alleged assault. The investigation and subsequent court proceedings will determine how the case develops.
