Bombay High Court Convicts Tarun Tejpal in 2013 Rape Case, Overturns 2021 Acquittal
In a landmark judgment delivered on Thursday, the Goa Bench of the Bombay High Court convicted former Tehelka editor-in-chief Tarun Tejpal in the 2013 rape case, overturning the 2021 acquittal granted by a Goa Sessions Court. The High Court allowed the appeal filed by the State of Goa, bringing a significant turn in one of India’s most closely watched criminal trials involving allegations of workplace sexual assault.
The case dates back to November 2013, when a junior colleague accused Tejpal of sexually assaulting and raping her inside the elevator of a luxury hotel in Goa during Tehelka‘s annual ThinkFest event. The allegations triggered nationwide outrage, led to Tejpal’s resignation from the magazine, and sparked renewed debate over workplace safety, accountability, and the handling of sexual harassment complaints in media organizations.
A Division Bench of Justices Neela Gokhale and Amit Jamsandekar set aside the trial court’s verdict, which had acquitted Tejpal in May 2021. The High Court held him guilty under multiple provisions of the Indian Penal Code, including rape and offences relating to sexual assault and outraging the modesty of a woman, reversing the conclusions reached by the Sessions Court.
The 2021 acquittal had attracted widespread legal scrutiny after the trial court’s reasoning, particularly its comments on the complainant’s conduct and credibility, was criticized by women’s rights groups and legal observers. The Goa Government challenged that verdict before the Bombay High Court, arguing that the trial court had improperly appreciated the evidence and committed serious legal errors while acquitting the accused.
With the conviction now recorded, the High Court has paved the way for separate proceedings on sentencing. The punishment to be imposed on Tejpal is expected to be considered in a subsequent hearing, where both the prosecution and the defence will make submissions on the appropriate sentence.
Soon after the verdict, Tarun Tejpal indicated that he would challenge the High Court’s decision before the Supreme Court. An appeal to the apex court is expected, making the case likely to enter another phase of judicial scrutiny after more than a decade of litigation.
The judgment marks a significant development in India’s criminal justice system, particularly in cases involving allegations of sexual violence at the workplace.
