Brigade Moves Madras High Court Against Revocation of Environmental Clearance for Pallikaranai Project

Real estate developer Brigade Enterprises has approached the Madras High Court challenging the Tamil Nadu State Level Environment Impact Assessment Authority’s (SEIAA) decision to revoke the environmental clearance (EC) granted for its residential housing project at Pallikaranai near Chennai. The company has argued that the revocation was arbitrary, procedurally flawed, and issued without giving it an opportunity to present its case.

The matter came up before Justice Mohammed Shaffiq, who issued notice to the SEIAA and other respondents, directing them to file their replies. The High Court has scheduled the next hearing for July 28, allowing the dispute over the project’s environmental approvals to proceed through judicial scrutiny.

Appearing for Brigade Enterprises, senior advocate P.S. Raman submitted that the environmental clearance had originally been granted on January 20, 2025, after the developer secured planning permission from the Chennai Metropolitan Development Authority (CMDA) and other statutory approvals. He contended that the SEIAA revoked the clearance through its order dated May 12, 2026, without issuing a show-cause notice, without furnishing the material relied upon, and without granting the company a personal hearing, thereby violating the principles of natural justice.

The petition further states that the project is situated on privately owned patta land classified as dry land (punjai) in official revenue records and has never been formally notified as wetland under the Wetlands (Conservation and Management) Rules, 2017. Brigade argues that, in the absence of such a determination by the competent authority, the SEIAA exceeded its statutory jurisdiction by treating the site as falling within a protected wetland zone.

According to the company, the revocation order also relied on a communication issued by the Tamil Nadu Wetland Authority dated April 16, 2026, which was never supplied to Brigade before the decision was taken. The petition contends that relying on undisclosed material deprived the developer of a fair opportunity to respond and renders the impugned order legally unsustainable.

The dispute stems from the SEIAA’s earlier decision to revoke the project’s environmental clearance after concluding that Brigade had allegedly commenced construction without obtaining mandatory permission from the Tamil Nadu State Wetland Authority, a condition attached to the environmental clearance. Environmental groups have maintained that the project falls within the ecologically sensitive Pallikaranai marsh ecosystem, a Ramsar wetland known for its biodiversity, flood mitigation, and groundwater recharge functions.

The case is being closely watched by developers, environmental activists, and urban planners because it raises important questions about the scope of environmental regulators’ powers, procedural fairness in revoking statutory approvals, and the legal status of land located near protected wetlands. The High Court’s eventual ruling could significantly influence future infrastructure and real estate projects proposed around environmentally sensitive areas in Tamil Nadu.
