Allahabad High Court Directs Bar Council To Act Against Advocates Accused Of Heinous Offences; Orders Statewide Crackdown
In a significant judgment aimed at safeguarding the integrity of the legal profession, the Allahabad High Court has directed the Bar Council of Uttar Pradesh to initiate disciplinary proceedings against advocates facing criminal prosecution for heinous offences. The Court observed that the legal profession cannot become a refuge for persons accused of grave crimes and emphasized that the justice delivery system must remain free from criminal influence.
While deciding a petition filed by an advocate challenging criminal proceedings, Justice Vinod Diwakar expanded the scope of the case after examining alarming data placed before the Court by the Uttar Pradesh Police. According to the figures, 4,157 advocates across the State are involved in 5,056 criminal cases, including allegations relating to murder, rape, kidnapping, dacoity, offences under the Gangsters Act and other serious crimes. The Court described the statistics as deeply disturbing and indicative of increasing criminalisation within the legal fraternity.
Expressing concern over the erosion of public confidence in the justice system, the High Court held that advocates accused of heinous offences should not be permitted to continue appearing before courts while facing trial for such serious charges. It directed the Bar Council of Uttar Pradesh to examine these cases and consider suspension of enrolment pending the conclusion of criminal trials, observing that such action would be regulatory rather than punitive and necessary to preserve the dignity of the profession.
The Court also ordered the Director General of Police and district authorities to prepare and periodically update a comprehensive database of criminal cases involving advocates. The information is to be shared with the Bar Council so that disciplinary action can be initiated without delay wherever warranted under the Advocates Act and the Bar Council Rules. The Bench stressed that regulatory bodies cannot remain passive when credible allegations involving grave offences exist against members of the profession.
In another major direction, the High Court ordered the transfer of criminal trials involving advocates accused of heinous offences to appropriate courts outside their regular place of practice wherever necessary. The objective, the Court said, is to ensure fair and impartial trials free from local influence, intimidation or conflict of interest, thereby protecting both the prosecution and the judicial process.
The judgment contains strong observations on the ethical responsibilities of lawyers, stating that advocates occupy a unique position as officers of the court and custodians of the rule of law. The Bench remarked that the administration of justice suffers irreparable damage if individuals facing allegations of grave criminal conduct continue to represent litigants without appropriate regulatory scrutiny.
Legal experts believe the ruling could have far-reaching consequences for professional regulation across the country. Although the immediate directions are addressed to the Bar Council of Uttar Pradesh and State authorities, the decision is expected to reignite debate on whether Bar Councils nationwide should adopt uniform mechanisms for dealing with advocates facing prosecution for serious criminal offences while ensuring that the presumption of innocence and due process remain protected.
