Supreme Court Questions Patna High Court’s Sexual Assault Ruling, Flags Narrow Interpretation of Attempt to Rape
The Supreme Court has expressed serious reservations over a recent Patna High Court judgment that held allegations of pressing a woman’s breasts and attempting to remove her salwar did not amount to the offence of attempt to rape. Taking note of the controversial ruling, the apex court questioned the legal reasoning adopted by the High Court and indicated that such an interpretation warranted closer judicial scrutiny.
The controversy stems from a Patna High Court judgment in which the accused was acquitted of the charge of attempt to rape. The High Court held that while the alleged acts constituted the offence of outraging a woman’s modesty, they did not satisfy the ingredients required to establish an attempt to commit rape, leading to a reduction in the severity of the charges.
During the hearing before the Supreme Court, the Bench expressed concern over the restrictive interpretation of the offence. The judges questioned whether allegations involving forcible disrobing, physical assault and other overt acts directed towards sexual violation could be viewed in isolation without examining the accused’s intention and the surrounding circumstances. The Court’s observations suggested that the legal threshold for attempt to rape cannot be assessed through an unduly narrow lens.
Senior Advocate Shobha Gupta brought the High Court judgment to the Supreme Court’s attention, arguing that such reasoning could create an undesirable precedent in sexual offence cases. She submitted that courts must adopt a victim-centric and legally consistent approach while evaluating allegations involving sexual violence, particularly where the conduct alleged points towards an intended sexual assault.
The Supreme Court’s intervention comes at a time when the judiciary has been emphasizing greater sensitivity in dealing with sexual offence cases. Just recently, the apex court approved comprehensive guidelines for judicial handling of such matters, directing courts across the country to avoid stereotypes and ensure a victim-sensitive approach while appreciating evidence and interpreting criminal law.
Legal experts believe the proceedings could have far-reaching implications for the interpretation of “attempt to rape” under criminal law. The outcome may clarify the distinction between sexual assault, outraging modesty and attempted rape, while reinforcing that courts must consider the accused’s intention, conduct and the totality of circumstances rather than isolated physical acts alone.
The matter is now expected to remain under the Supreme Court’s consideration, with the apex court’s eventual ruling likely to shape future judicial interpretation of sexual offence cases and strengthen consistency in the application of criminal law across courts in the country.
