Supreme Court Clears Path for Uttarakhand High Court’s Shift to Haldwani, Sets Aside Referendum Order

The Supreme Court has paved the way for the long-pending relocation of the Uttarakhand High Court from Nainital to Haldwani, setting aside an earlier order that had effectively stalled the project. In a significant ruling, the apex court directed the Uttarakhand government to hand over the identified land in Haldwani for construction of the new High Court complex, bringing renewed momentum to one of the state’s most debated infrastructure projects.

The Bench held that the question of selecting a site for a High Court is fundamentally an administrative matter to be resolved through consultation between the judiciary and the State government. It observed that such decisions cannot be made contingent upon a referendum or public consultation process among lawyers, litigants, or citizens. Consequently, the Supreme Court set aside the Uttarakhand High Court’s earlier direction that had sought opinions through an online referendum before proceeding with the relocation.

The dispute traces back to 2022, when the Uttarakhand Cabinet granted in-principle approval to shift the High Court from Nainital to Haldwani in view of growing space constraints, traffic congestion, inadequate infrastructure, accommodation shortages, and the difficulties faced by litigants travelling from remote districts. Nearly 26 hectares of land were subsequently identified in Haldwani for the proposed judicial complex.

However, the proposal ran into difficulty after the High Court declined to accept the identified land, pointing out that a substantial portion of the site was covered with trees and that large-scale felling would be required for construction. Concerned over environmental consequences, the High Court rejected the proposed site and sought broader public consultation, leading to prolonged uncertainty over the relocation.

The Supreme Court has now reversed that approach, emphasizing that while environmental considerations remain important, they cannot indefinitely delay essential judicial infrastructure. The Court directed the State to transfer possession of the identified land within the stipulated timeframe and indicated that the development of the new complex should proceed with appropriate safeguards for preserving greenery wherever feasible.

The ruling is expected to significantly improve judicial infrastructure in Uttarakhand. A modern High Court complex in Haldwani is likely to provide better connectivity, easier access for litigants from the plains and remote districts, expanded courtrooms, enhanced digital facilities, and adequate space for judges, advocates, and court staff. It is also expected to reduce the logistical challenges associated with operating from the congested hill town of Nainital.

At the same time, the judgment is likely to rekindle debate among members of the legal fraternity and residents of Nainital, many of whom have historically opposed shifting the High Court due to concerns over the city’s legal identity and the economic impact on the region. Nevertheless, the Supreme Court’s decision substantially clears the legal hurdles, bringing the proposed relocation closer to implementation after years of administrative and judicial uncertainty.
