Government Has No Central Record of All Advocates Since Independence; Parliament Reveals Only Current State-Wise Registration Data

The Union Government has effectively acknowledged that India does not maintain a single, comprehensive record of every advocate enrolled since Independence. Instead, the Ministry of Law and Justice informed the Rajya Sabha that the available figure represents advocates currently registered with various State Bar Councils, not the cumulative number of lawyers enrolled in the country since 1947.

According to the Ministry’s latest data placed before Parliament, 20,13,081 advocates are registered across different State Bar Councils and courts in India. However, this figure is compiled from data received from individual State Bar Councils and does not constitute a live, centrally maintained national register of advocates.

The absence of a unified database stems from the structure created under the Advocates Act, 1961. Enrollment of advocates is carried out by individual State Bar Councils, each maintaining its own records and enrollment rolls. While the Bar Council of India regulates the legal profession nationally, it does not presently operate a real-time digital repository of every advocate enrolled since Independence.

Legal experts have repeatedly pointed out that this fragmented system creates significant administrative challenges. Without a centralized digital registry, it becomes difficult to accurately determine the number of practicing advocates, identify deceased or inactive members, prevent duplicate enrollments, and curb the problem of fake practitioners. The issue has also gained prominence amid demands for greater transparency in legal regulation.

The debate has prompted calls for a nationwide verified database linking all State Bar Councils through a common digital platform. Supporters argue that such a system would strengthen professional regulation, improve public access to verified lawyer information, streamline disciplinary proceedings, and enhance confidence in the justice delivery system.

As matters stand, although Parliament has disclosed that India has 20,13,081 registered advocates, neither the Central Government nor the Bar Council of India maintains an official cumulative record of every advocate enrolled since Independence. The available data remains decentralized across the State Bar Councils, highlighting the continuing need for a unified national advocate registry.
