Madras High Court Admits Pleas Challenging CM Joseph Vijay and Minister Aadhav Arjuna’s Election Victories
Court Issues Notice on Batch of Election Petitions Alleging Irregularities in 2026 Tamil Nadu Assembly Polls; Merits Yet to Be Examined
The Madras High Court has admitted a batch of election petitions challenging the victories of Tamil Nadu Chief Minister C. Joseph Vijay and State Sports Minister Aadhav Arjuna in the 2026 Tamil Nadu Legislative Assembly elections. After a preliminary examination, the Court found that the petitions raised issues requiring adjudication and accordingly issued notices to the respondents.
The petitions relate to Joseph Vijay’s victories from the Perambur and Tiruchirappalli (East) Assembly constituencies. Of the four petitions admitted against the Chief Minister, three challenge his election from Perambur, while one questions his victory from Tiruchirappalli (East). The High Court also admitted two election petitions challenging Sports Minister Aadhav Arjuna’s victory from the Villivakkam Assembly constituency.
One of the petitions challenging the Chief Minister’s election from Perambur was filed by R.D. Sekar, the defeated DMK candidate. The petitioners have alleged various irregularities in the conduct of the election and have sought to have the election results declared void under the provisions of the Representation of the People Act, 1951. The detailed allegations will be examined during the course of the trial.
While admitting the petitions, the High Court clarified that the issuance of notice does not amount to a finding on the merits of the allegations. Admission merely signifies that the Court has found the petitions to disclose triable issues warranting a judicial examination. The respondents will now have an opportunity to file their counter-affidavits before the matter proceeds further.
Election petitions are governed by a specialized statutory framework under the Representation of the People Act, 1951, under which High Courts possess exclusive jurisdiction to decide disputes relating to the validity of elections to State Legislative Assemblies. The petitioner must establish grounds recognized under the Act, such as improper acceptance or rejection of nominations, corrupt practices, or material irregularities affecting the election outcome.
If an election petition ultimately succeeds, the High Court may declare the election of the returned candidate void and, in appropriate cases, declare another candidate duly elected if the statutory requirements are satisfied. However, until such a final determination is made, the election results remain valid and the elected representatives continue to hold office.
The proceedings are likely to attract considerable political attention, as they involve the election victories of the State’s Chief Minister and a Cabinet Minister. Election petitions often require detailed examination of documentary evidence, electoral records and witness testimony, making them among the most fact-intensive proceedings before constitutional courts.
With notices now issued, Joseph Vijay and Aadhav Arjuna are expected to file their responses contesting the allegations. The Madras High Court will thereafter frame the issues for trial and determine, on the basis of evidence, whether any of the alleged irregularities materially affected the outcome of the 2026 Assembly elections. Until then, the admission of the petitions should not be construed as an expression of opinion on the validity of their electoral victories.
